Short version: Use Pelican Budgeting to track your spending and goals. We provide information, not financial or tax advice. Be kind, lawful, and honest. If you don’t agree with these terms, don’t use the app.

Who we are

Pelican Budgeting is operated by Anthony Alcaraz Cen dba Pelican Budgeting (“we”, “us”). These Terms are a contract between you and us.

Using Pelican Budgeting

You must be at least 13 years old (or the age required in your country) to use the app.
By using the app or website, you agree to these Terms and our Privacy Policy.
We grant you a personal, non-transferable, revocable license to use the app for your own budgeting.

Not financial advice

Pelican Budgeting is for educational and planning purposes only. We do not provide financial, legal, investment, or tax advice. You’re responsible for your decisions.

Your content

You own the data you enter. It lives on your device.
You’re responsible for backups if you need them. (Deleting the app or using in-app reset will remove your local data.)
Don’t submit anything illegal or that violates others’ rights when contacting support or interacting with our website.

Prohibited uses

No reverse engineering, scraping, or interfering with our services.
No using the app to harass, harm, or defraud others.
No attempts to bypass security or rate limits.

Third-party services

We may use third-party providers for the website (e.g., Supabase for the waitlist and an email provider to contact you). Their terms and privacy policies apply to their services.

App updates & availability

We may update or discontinue features at any time. We try to avoid downtime, but services may be unavailable for maintenance or issues.

Subscriptions & purchases

Paid features (if offered) are billed via Apple’s in-app purchase system. Prices and terms are shown in-app. Billing and refunds are handled by Apple and subject to Apple’s policies.

Disclaimers

THE APP AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; WHERE THEY DON’T, WE LIMIT WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Indemnity

You agree to defend and hold us harmless from claims arising from your misuse of the services or violation of these Terms.

Termination

You can stop using the app at any time. We may suspend or end access if you violate these Terms or misuse the services.

Changes to these Terms

We may update these Terms. If changes are material, we’ll notify you in the app or on the website. Continued use means you accept the changes.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Courts in San Diego County, California, will have jurisdiction, unless applicable law requires otherwise.
